Terms of Service

1. Eligibility and accounts

You must be able to form a binding agreement where you live. A child under 13 may not create or control a FinDex account independently. A parent or legal guardian may use their own account with a child under supervision and accepts responsibility for that account's activity.

You must use an email address or Apple/Google account you are authorized to use, protect your password and provider account, promptly update inaccurate information when the app supports it, and notify support@findexaquarium.com if you reasonably believe the account has been compromised. You are responsible for activity under your account.

2. Permitted and prohibited use

You may use FinDex for personal aquarium recordkeeping and the supported optional features. You may not:

• Break the law or infringe another person's rights.
• Upload content you do not have the right to use.
• Probe, bypass, disable, or interfere with authentication, ownership, quota, subscription, or security controls.
• Use bots, scripts, multiple accounts, or other methods to evade complimentary-use or safety limits.
• Submit malicious code, abusive material, or content intended to harm a person, animal, system, or service provider.
• Resell, copy, reverse engineer, or exploit FinDex except as applicable law expressly permits.

3. Your aquarium content

You retain the rights you hold in tank and fish records, notes, questions, and photos you submit. You represent that you have permission to upload and process that content and that it does not violate law or another person's rights.

You give FinDex a limited, nonexclusive license to host, copy, process, display, and transmit your content only as needed to operate, secure, troubleshoot, and support the service. This includes sending selected content to OpenAI only when you initiate an AI feature after accepting the separate AI data-sharing disclosure. This license ends when the content is deleted from active FinDex systems, subject to reasonable backup, security, and legal retention.

4. FinDex intellectual property

FinDex software, branding, design, and original content are owned by Zach Smet or licensed for use and are protected by applicable laws. These terms do not transfer ownership of FinDex or give permission to use FinDex branding outside normal use of the service.

5. Free manual features

Manual tank and fish recordkeeping is available without FinDex Pro. Network access and an account are still required for cloud-backed records. FinDex may reasonably update the available features, but a purchase is not required merely to create or edit ordinary tank and fish records in the current version.

6. Two complimentary AI analyses

Each eligible verified account currently receives two complimentary AI analyses for the lifetime of that account. The two uses are shared across all OpenAI-backed features, including fish photo identification, aquarium image analysis, follow-up questions, image-assisted fish or tank record drafts, and AI care reports.

• Complimentary uses have no cash value, are not transferable, and are not an Apple subscription offer.
• An operation counts once FinDex begins the provider request. A provider-started request may count even if it later times out, is refused, returns invalid output, or does not produce a saved result.
• Authentication, email verification, validation, record ownership, image preparation, active consent, subscription checks, or other failures before provider processing begins do not consume a use under the current implementation.
• Reopening a completed complimentary result does not consume another use.
• Deleting a scan, message, report, photo, or result does not restore a use.
• Signing out, reinstalling the app, changing devices, or deleting local app data does not reset the server-managed allowance.

After both uses are consumed, continued AI usage requires FinDex Pro. FinDex may deny suspicious or unsafe requests and applies reasonable rate limits even to complimentary operations.

7. FinDex Pro subscriptions

FinDex Pro provides continued access to supported AI features, subject to hourly, monthly, security, safety, provider, and fair-use limits. A Pro operation does not consume an unused complimentary balance. FinDex Pro does not guarantee that every request will succeed or that a particular AI model or feature will always remain available.

FinDex Pro is an auto-renewing subscription offered through Apple's In-App Purchase system. Apple displays the product, billing duration, localized price, taxes where applicable, and purchase terms before confirmation. FinDex does not receive your complete payment-card number.

Renewal and billing

Payment is charged to the Apple account used to confirm the purchase. The subscription renews automatically unless canceled under Apple's applicable rules before the renewal date. Apple controls billing, renewal timing, payment failures, price-change notices, and store receipts.

Cancellation and subscription management

Use Manage Subscription in FinDex Settings or Apple's subscription settings to view or cancel FinDex Pro. Cancellation normally stops future renewal and does not retroactively remove access already paid for; Apple's current terms control the exact result.

Restore Purchases

Restore Purchases asks Apple and RevenueCat to reconnect an eligible purchase to the currently signed-in FinDex account. Restoration does not charge you again. You are responsible for signing in to the intended FinDex and Apple accounts.

Refunds

Apple handles App Store payment disputes and refund requests under Apple's policies. FinDex cannot promise or directly issue an Apple refund.

8. AI output and aquarium guidance

AI-generated identification, observations, explanations, and care suggestions may be inaccurate, incomplete, outdated, or inappropriate for your animal or aquarium. A photo cannot establish water chemistry, cycling status, hidden equipment, exact tank dimensions, or a definitive disease diagnosis.

You are responsible for confirming species, compatibility, water conditions, care requirements, and any action you take. Use reliable references, measured water tests, and an aquatic veterinarian or qualified aquarium professional when health, safety, or uncertainty warrants it.

9. Availability and changes

FinDex depends on internet connectivity and services provided by Supabase, OpenAI, RevenueCat, Apple, Expo, and others. Features may be delayed, unavailable, changed, secured, or discontinued. We may update limits, models, features, and technical requirements to manage safety, cost, abuse, provider changes, or law, subject to applicable consumer rights and store rules.

10. Suspension and termination

We may limit or suspend access when reasonably necessary to investigate abuse, protect users or systems, comply with law, or address a serious violation of these terms. Where practical and appropriate, we will provide notice or an opportunity to resolve the issue. You may stop using FinDex or permanently delete the account at any time.

11. Account deletion

Use Settings, Delete Account inside FinDex to initiate permanent deletion. See the Account Deletion instructions. Deleting the FinDex account does not automatically cancel FinDex Pro. Apple subscription management is a separate action.

12. Disclaimers

To the extent permitted by law, FinDex is provided "as is" and "as available." We do not promise uninterrupted operation, error-free data, perfect identification, successful aquarium outcomes, continued availability of a particular feature, or that AI output will be suitable for your circumstances. Nothing in these terms excludes warranties or rights that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by law, Zach Smet is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from FinDex, service interruption, lost records, or reliance on AI or aquarium guidance. This limitation does not apply where prohibited and does not limit liability that applicable law does not allow to be limited.

14. Governing law

These terms are governed by the laws of Wisconsin, United States, without regard to conflict-of-law principles, while preserving mandatory consumer protections and other non-waivable rights that apply where you live.

15. Apple Standard EULA

Apple's Standard Licensed Application End User License Agreement (Standard EULA) may also apply to the iOS application. These terms supplement and do not override mandatory Apple terms or applicable consumer protections.

16. Changes to these terms

We may update these terms when the product, providers, or law changes. The updated page will show a revised effective date, and we will provide additional notice when appropriate. Continued use after revised terms take effect means you accept them where permitted by law.
